Disclaimer
What Nexthara is, what we are not, and the third-party outcomes we do not control.
1. Regulatory positioning
What we are
A Limited Liability Partnership registered in India. We provide education advisory, university application facilitation, and loan facilitation services. We are registered under the LLP Act 2008.
What we are not
Not an NBFC (RBI-registered). Not a bank. Not a university. Not a visa consultant registered under the ICRA / MARA / OISC. Not a licensed immigration attorney. Not an insurance intermediary.
Because we do not lend from our own capital or accept deposits, we are outside the ambit of the RBI's NBFC framework. We facilitate loans by connecting you to our network of partner banks and non-banking financial companies, each of which is a duly regulated financial institution in its home jurisdiction. All lending decisions — KYC, credit assessment, sanction, disbursement, and the loan agreement itself — are between you and the specific lender you choose. The identities and specific commercial terms of our partner lenders are confidential business arrangements and are disclosed on a need-to-know basis when you engage with a specific lender.
2. No outcome guarantees
Nothing on this website, in our marketing materials, in verbal counselling, or in our WhatsApp / email communications constitutes a guarantee of:
- University admission — final decision rests with the university
- Visa approval — final decision rests with UKVI, DHA, Campus France, Immigration NZ, or the respective visa authority
- Loan sanction, amount, or interest rate — final decision rests with the lender
- Post-study employment or salary — depends on the labour market, employer decisions, and your academic performance
- Part-time work availability — depends on local job market and visa work-hour restrictions
- Permanent Residence or citizenship pathway — depends on the destination country's immigration policy at the relevant time
- Currency exchange rates — fluctuate independently of any provider
- Timelines for any application, sanction, or disbursement
3. Accuracy of information
We take reasonable care to keep information on our website accurate — including university fees, deposit amounts, English test requirements, visa rules, and lender terms. However:
- Universities update fees and admission criteria annually or more frequently — always verify directly with the university before applying
- Visa rules change; check the current UKVI / DHA / Campus France / official government portal before making decisions
- Lenders update interest rates and eligibility criteria continuously; the sanction letter is the definitive source
- Currency conversions on our website are indicative; actual conversion depends on the rate at the time of your transaction
To the maximum extent permitted by law, Nexthara does not warrant that information on this website is complete, accurate, or current. Please cross-check with the relevant primary source before making financial or immigration decisions.
4. Third-party links & services
Our website and communications may link or refer to third-party services — universities, lenders, application-facilitation platforms, forex providers, insurance providers, accommodation platforms, and others. We do not control these third parties and are not responsible for:
- The accuracy of their information
- The availability of their websites or services
- Their pricing, terms, or refund policies
- Their handling of your data (subject to their own privacy policies)
- Any dispute arising from your interaction with them
5. Educational nature of our content
Content on our website — including university profiles, course guides, loan comparisons, visa checklists — is provided for educational and informational purposes only. It does not constitute:
- Financial advice — consult a SEBI-registered financial adviser for personal financial planning
- Legal advice — consult a licensed lawyer for immigration or contract law questions
- Tax advice — consult a chartered accountant for FEMA, LRS, and tax implications
- Investment advice — an education loan is a personal financial decision; assess your repayment capacity carefully
6. Forex & foreign transactions
When you remit funds abroad for tuition, deposits, or living expenses:
- All transactions are subject to the Foreign Exchange Management Act 1999 (FEMA) and the Liberalised Remittance Scheme (LRS) of the RBI
- You are responsible for accurate disclosure on the LRS declaration (Form A2)
- Nexthara does not handle your forex; you remit directly through an authorised dealer (your bank) or a partner forex vendor
- Currency fluctuations between quotation and execution are borne by you
7. Risk of education loans
8. Marketing content & testimonials
Student testimonials, success stories, and photographs used in our marketing are published with the explicit consent of the featured student. Individual results vary. A student's specific outcome (university, loan amount, visa timeline) is unique to their profile and does not indicate what any other student can expect.
9. Reservation of rights
We reserve the right to modify our services, pricing, partner lineup, and website content at any time without prior notice. Any changes take effect from the date of update on our website. Prior versions of policies are archived and available on request.
10. Limitation of liability
See our Terms of Service for the complete limitation-of-liability clause. In summary: Nexthara is not liable for third-party outcomes (visa, loan, admission), force majeure events, currency fluctuations, or indirect / consequential damages. Our maximum aggregate liability is capped as described in the Terms.
This disclaimer is part of our Terms of Service and should be read together with it. In case of any conflict, the Terms prevail. Governed by Indian law; jurisdiction at Kozhikode, Kerala. Version v1.0 dated 29 July 2026.
