1. Acceptance of these terms
By accessing our website, contacting us via any channel (WhatsApp, phone, email, form), or engaging our counsellors, you agree to be bound by these Terms of Service and by our Privacy Policy and Refund Policy. If you do not agree, please do not use our service.
2. Who can use our service
- You must be at least 18 years old, or, if a minor, you must engage us together with your legal guardian who countersigns all documentation
- You must have the legal capacity to enter a contract under the Indian Contract Act 1872
- You must provide accurate identity information; we may verify identity via passport or Aadhaar
- Our service is intended for individuals genuinely seeking to study abroad — not for fraudulent visa purposes
3. Nature of our service
Nexthara Overseas LLP is:
- An education advisory and loan facilitation business — not a lender, not a university, not a visa agent, not a government body
- Not registered as an NBFC with the RBI — see our Disclaimer for the full clarification
- An intermediary that may, at our discretion, connect you to our network of partner lenders and universities. The specific partners we work with, and the terms of those partnerships, are confidential commercial arrangements
Specifically we provide:
- University selection guidance and shortlisting
- Application preparation and submission
- Loan pre-eligibility checks and matching to appropriate lender(s)
- Application submission to the lenders you approve
- Visa document guidance and mock interviews
- Post-CAS support until safe arrival at university
- Optional referrals to forex, insurance, and accommodation partners
We do not provide:
- Loans directly from our own capital (we facilitate loans from partner lenders)
- Guaranteed admission, visa, or loan outcomes
- Immigration legal advice (we are not registered immigration lawyers)
- Post-arrival academic or immigration compliance (that transfers to you and your university on arrival)
- Refunds of fees paid to third parties (see Refund Policy)
4. Fees & commissions
Our service is free to students and their families. We do not charge you any advisory, consultation, application, or handling fee.
Our revenue comes from commercial arrangements with our university, lender, and service-provider partners. The specific terms of those arrangements are confidential and vary by partner and by service. No part of our revenue is deducted from any fee you pay to a third party. If any Nexthara staff member ever demands a fee, commission, or cash payment from you personally, report it immediately to hello@nexthara.in — such demands are a violation of our internal policy and will be dealt with accordingly.
All fees you pay — university tuition, visa fees, IHS, insurance, forex, accommodation, and any government charges — are paid directly to those providers. Nexthara does not hold your money at any point and does not intermediate any financial transaction between you and any provider. Refunds of such fees follow each provider's own policy — see Refund Policy.
5. Your obligations
By using our service, you commit to:
- Provide accurate, complete, and current information about your identity, academics, finances, and immigration history
- Submit only genuine documents that belong to you or your legitimate legal sponsor
- Personally sit for any English language test (IELTS / PTE / TOEFL / OET / Duolingo) submitted on your behalf
- Answer visa interviews honestly and in your own words
- Respond to visa-critical, CAS-critical, or loan-critical requests within 48 hours
- Not pay any cash to a Nexthara employee personally — our service is free
- Not use our service for purposes other than a genuine study-abroad application
- Comply with all applicable laws in India and in your destination country
6. No outcome guarantees
We make no guarantee or promise regarding:
- Admission to any specific university or programme
- Visa approval
- Loan sanction amount, interest rate, or approval
- Post-study employment or salary
- Availability of part-time work
- Eventual Permanent Residence or citizenship
- Currency exchange rates at time of payment
- Timelines set by embassies, universities, or lenders
Each of these outcomes is at the sole discretion of the respective third party. Our published statistics (e.g., "91% approval rate") reflect historical outcomes and do not constitute a guarantee for your individual application.
7. Third-party services & links
Our website and communications may include links to third-party services (universities, lenders, aggregators, forex, insurance). We do not control these third parties. Your use of any third-party service is subject to that service's own terms and privacy policies. Nexthara is not responsible for the availability, content, accuracy, or practices of any third-party site or service.
8. Intellectual property
All content on this website — including text, graphics, logos, code, and design elements — is the property of Nexthara Overseas LLP and protected under Indian copyright law. You may not reproduce, distribute, or create derivative works without our written permission, except for personal, non-commercial use.
You retain ownership of the documents you provide to us; you grant us a limited licence to use them solely to deliver our service to you.
9. Prohibited use
You must not:
- Attempt to gain unauthorised access to our systems, admin dashboard, or any user's data
- Scrape, harvest, or automate access to our website
- Impersonate any person, or misrepresent your relationship to any person
- Submit false, forged, or manipulated documents
- Use our service to violate any law in India or any destination country
- Use our service to launder money or facilitate any financial fraud
- Send us spam, viruses, or malicious code
Violations may result in immediate termination of service, referral to law enforcement, and civil liability.
10. Termination
Either party may terminate the service relationship at any time by written notice:
- By you: at any point, by email to hello@nexthara.in. Applications already submitted on your behalf remain your responsibility to complete or withdraw
- By us: if you materially breach these terms, submit fraudulent documents, become abusive to our staff, or if we reasonably suspect illegal use
Termination does not entitle you to a refund of fees paid to third parties. Any data-retention obligations under our Privacy Policy continue to apply.
11. Limitation of liability
To the maximum extent permitted by law:
- Nexthara is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, savings, business opportunity, goodwill, data, reputation, admissions, visa outcomes, or opportunity to remit funds
- Our total aggregate liability to you for all claims arising out of or in connection with our service — whether in contract, tort, statute, or otherwise — will not exceed Indian Rupees Ten Thousand (₹10,000) in the aggregate across all your claims
- We are not liable for outcomes controlled by third parties, including visa decisions, loan sanctions, admission decisions, currency fluctuations, university operations, embassy processes, insurer decisions, or destination-country regulatory changes
- We are not liable for any delay, failure, or damage caused by an event of force majeure (see Sec 16)
- To the maximum extent permitted by law, all implied warranties — including of merchantability, fitness for a particular purpose, and non-infringement — are disclaimed. Our service is provided on an "as is" and "as available" basis
These limitations apply even if a remedy fails of its essential purpose. Nothing in these Terms excludes liability that cannot be excluded or limited under Indian law, including under the Consumer Protection Act 2019 for personal injury or gross negligence.
12. Indemnification
You agree to indemnify and hold harmless Nexthara Overseas LLP, its partners, employees, and contractors against any claims, losses, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your submission of false, forged, or manipulated documents
- Your violation of any law or third-party right
- Any claim by a third party (university, lender, embassy) arising from your actions or misrepresentations
13. Governing law & jurisdiction
These Terms are governed by the laws of India. All disputes arising out of or in connection with these Terms or our service shall be subject to the exclusive jurisdiction of the courts at Kozhikode, Kerala, India.
14. Dispute resolution
Before initiating any legal action, you must first follow our internal escalation ladder in good faith:
- Raise the issue with your assigned counsellor
- Escalate to our Head of Operations at grievance@nexthara.in
- Escalate to the Founding Partner via grievance@nexthara.in marked for their attention
- Formal grievance via our Grievance Officer
Most disputes get resolved at the counsellor or operations level within 48–72 hours. If they don't, we prefer good-faith mediation over litigation. Your failure to exhaust this internal escalation ladder before initiating any external proceeding is a material breach of these Terms, and may be raised as a defence.
15. Changes to these Terms
We may update these Terms from time to time. The current version and effective date are shown at the top of this page. Material changes will be announced via email and homepage banner for 30 days. Continued use of our service after a change means you accept the new version. Prior versions are archived and available on written request.
16. Force majeure
Nexthara is not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: acts of God, pandemic, epidemic, war, terrorism, civil unrest, government action, embassy closures, visa-regime changes, changes in immigration policy, sanctions, strikes, labour disputes, internet outages, cloud-service failures, cyber-attacks, power failures, natural disasters, and any other event of force majeure. On the occurrence of such an event, our obligations are suspended for the duration of the event.
17. Only written communication binds Nexthara
You agree that no verbal statement, WhatsApp message, informal note, or promise made by any counsellor, agent, or employee is binding on Nexthara Overseas LLP unless it is expressly confirmed in writing on Nexthara letterhead or from an official @nexthara.in email account and signed or authorised by a Partner of the LLP. You will not rely on any informal statement to override these Terms, our Privacy Policy, our Refund Policy, or the Student Acknowledgment.
18. Anti-circumvention
You agree not to use information, introductions, or facilitation provided by Nexthara to bypass, undercut, or circumvent our commercial arrangements with our partners. This includes, without limitation: using our shortlists to apply directly and then requesting Nexthara to service the application at no cost, or leveraging our lender introductions to negotiate directly on terms inconsistent with our facilitation.
19. Time limit for claims
Any claim, cause of action, or dispute arising out of or in connection with our service or these Terms must be brought within twelve (12) months of the date on which the cause of action first arose. After that period, the claim is time-barred and permanently waived, to the maximum extent permitted by law.
20. Individual disputes only
Disputes with Nexthara are brought in your individual capacity. You will not participate in any class action, representative action, or consolidated proceeding against Nexthara. Nothing in this clause limits your statutory rights that cannot be waived under Indian law.
21. General provisions
- Entire agreement. These Terms, together with our Privacy Policy, Refund Policy, Grievance Policy, Disclaimer, and the Student Acknowledgment (where signed), constitute the entire agreement between you and Nexthara Overseas LLP and supersede all prior oral or written communications and representations.
- Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions continue in full force and effect, and the invalid provision is replaced by an enforceable provision that most closely reflects the original intent.
- No waiver. No failure or delay by Nexthara in exercising any right or remedy under these Terms operates as a waiver of that right or remedy. A single or partial exercise of a right does not preclude any further exercise.
- Assignment. You may not assign, transfer, or sub-licence any of your rights or obligations under these Terms without our prior written consent. Nexthara may assign these Terms to a successor, affiliate, or acquirer in connection with a merger, acquisition, or restructuring without your consent.
- No third-party beneficiaries. These Terms are for the benefit of you and Nexthara only. No other person has any right to enforce any provision.
- Notices. Notices to you may be sent to the email or phone you have registered with us. Notices to Nexthara must be sent by email to hello@nexthara.in with a copy to our registered address.
- Language. The authoritative version of these Terms is the English version published at
nexthara.in/terms. Any translation is for convenience only. - Headings. Section headings are for reference only and do not affect the interpretation of these Terms.
22. Your acknowledgment
By using our service, you acknowledge that you have read these Terms, that you have had the opportunity to seek independent legal advice on them, and that you accept them freely and without duress. If you disagree with any part, your only remedy is to stop using our service.
